Terms of Service

Welcome to Kin Therapy, Inc. (“Kin,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Kin websites, mobile and web applications (including the Kin teen, parent, and clinician apps), AI–augmented companions, clinical services, tele-health platform, and any related content or functionality we provide (collectively, the “Service”). Please read these Terms carefully—by creating an account, scheduling or attending a session, or otherwise using the Service, you agree to be bound by them.


1. Acceptance of the Terms

By accessing or using the Service you (a) confirm that you have read, understood, and agree to these Terms and our Privacy Notice; and (b) represent that you have the legal authority to enter into these Terms on your own behalf or on behalf of the minor or entity you represent.


  1. Age 18+. You may create your own account and use the Service if you are at least 18 years old.
  2. Age 13–17. Users aged 13 through 17 may participate only with an account created or expressly approved by a parent or legal guardian, who accepts these Terms on the minor’s behalf and remains responsible for all use of the Service.
  3. Under 13. We do not knowingly collect personal information from children under 13; if you believe a child under 13 has provided us information, please contact us immediately at legal@kin-therapy.com.
  4. Residency & Licensing. You may use the clinical components of the Service only if you reside in a U.S. state where Kin’s professional corporation (PC) or contracted clinicians are legally licensed to practice³ .

3. Description of Services

Kin delivers a virtual Intensive Outpatient Program (IOP) for teens and young adults with moderate-to-severe anxiety or depression, supplemented by:

  • Individual, group, and family tele-therapy
  • AI-driven teen and parent companions that provide 24/7 skills coaching
  • A clinician dashboard that automates scheduling, documentation, billing, and compliance

Kin is not an emergency or crisis service. If you believe you or someone else is in danger, call 911 or go to the nearest emergency department.


4. No Medical Advice; No Provider–Patient Relationship

All information on the Service—including AI-generated messages—is for educational purposes only. It does not replace professional medical advice, diagnosis, or treatment from a qualified provider. A provider–patient relationship is formed only after you (or your parent/guardian) complete required intake forms, consent to treatment, are accepted into the program, and are matched with a licensed clinician.


5. Accounts, Security & Accuracy

  • Registration. You agree to provide true, current, and complete information during sign-up and to keep it updated.
  • Confidential Credentials. Keep your login credentials secure and notify us promptly if you suspect unauthorized use.
  • Device Requirements. Tele-health sessions require a reliable internet connection, camera, and microphone; you are responsible for meeting these requirements.

6. Insurance, Fees & Billing

  1. Insurance Claims. Where available, we will bill your commercial or Medicaid plan for covered IOP services under applicable CPT codes (e.g., 0906 or 0907). You authorize Kin and its professional entity to release information necessary to process claims and to receive payment directly.
  2. Out-of-Pocket Costs. You are responsible for any co-pays, co-insurance, deductibles, or non-covered services.
  3. Cancellation & No-Show. Sessions cancelled with less than 24 hours’ notice or missed entirely may incur a fee of up to the full session rate.

7. User Conduct

You agree not to:

  • Violate any applicable law or regulation
  • Harass, threaten, or harm other participants or clinicians
  • Upload content that is unlawful, hateful, or infringes another’s rights
  • Reverse-engineer, scrape, or attempt to access the Service’s source code
  • Use the Service while driving or in other situations that require full attention

8. Community & Peer Group Guidelines

Our group sessions and in-app communities rely on mutual respect:

  • Maintain confidentiality—do not disclose another participant’s personal information outside the session.
  • Refrain from gossip, bullying, or sharing self-harm instructions.
  • Kin may remove any user or content that violates these standards at its sole discretion.

9. AI Features & Limitations

Kin’s AI companions use large-language-model technology to deliver on-demand coaching and skills practice. The companions are not licensed clinicians and may generate inaccurate or inappropriate suggestions. You understand and accept that:

  • AI output is probabilistic and may occasionally be misleading.
  • A human clinician reviews AI-generated care-plan drafts before adoption.
  • You will not rely on AI messages for emergency decision-making.

10. Intellectual Property

All software, text, graphics, logos, and other materials in the Service are owned by Kin or its licensors and are protected under U.S. and international IP laws. Kin grants you a personal, non-exclusive, revocable, non-transferable license to use the Service in accordance with these Terms. You retain ownership of content you submit but grant Kin a license to use, reproduce, and display that content solely to operate the Service.


11. Privacy & HIPAA

Kin’s Privacy Notice explains how we collect, use, and protect personal information, including Protected Health Information (PHI) under the Health Insurance Portability and Accountability Act (HIPAA). We implement administrative, technical, and physical safeguards to secure PHI and maintain Business Associate Agreements (BAAs) with our vendors where required.


12. Third-Party Services

The Service may link to or integrate with third-party platforms (e.g., electronic health-record systems, pharmacies, labs, insurers). Kin is not responsible for third-party content, terms, or privacy practices.


13. Termination

We may suspend or terminate your access to the Service at any time for any violation of these Terms or applicable law. You may close your account at support@kin-therapy.com. Sections that by their nature should survive termination (e.g., disclaimers, limitation of liability) will continue to apply.


14. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. KIN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.


15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIN AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, EVEN IF KIN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL KIN’S AGGREGATE LIABILITY EXCEED THE GREATER OF $500 OR THE AMOUNT YOU PAID KIN FOR SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain disclaimers of warranties or limitations of liability, so the above limitations may not fully apply to you.


16. Indemnification

You agree to defend, indemnify, and hold harmless Kin, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party right.


17. Dispute Resolution & Governing Law

  • Informal Resolution. Contact us first at support@kin-therapy.com to attempt to resolve any dispute informally.
  • Arbitration. If we cannot resolve a dispute within 30 days, you and Kin agree to binding arbitration under the rules of the American Arbitration Association, on an individual basis (no class actions), unless prohibited by law.
  • Governing Law. These Terms are governed by the laws of the State of Delaware (Kin’s state of incorporation), without regard to conflict-of-laws principles.

18. Changes to These Terms

We may revise these Terms from time to time. We will post the updated version with a new effective date. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
